Does the Lemon Law Cover Motorcycles?

Lemon law attorneys are often asked if the California Lemon Law covers motorcycles, as well. The short answer is, “yes.” Although the lemon law’s provisions, which are applicable to motorcycles, fall under a different section of the California Civil Code, our state’s strong consumer protections apply to motorcycles as well as cars, trucks, RV’s, and other motor vehicles. In the case of motorcycles, given the heightened safety concerns of riders, warranty repairs are all the more critical under California’s lemon law.  

As motorcycles have become more and more ubiquitous throughout the state, riders are experiencing more and more defects and warranty issues with their bikes. If your motorcycle has had a tortured repair history, fortunately, an experienced motorcycle lemon law attorney can assist in getting your money back; plus, in certain cases, civil penalties above what you paid for the motorcycle.  

In California, there are a number of ways in which a motorcycle can be considered a lemon:

  • Excessive Warranty Repairs: The most common way a motorcycle can be a lemon is if it’s been in the shop an excessive number of times for warranty repairs.  
  • Excessive Time in the Shop: A motorcycle can also be considered a lemon if it has spent too much time in the shop.  If the repairs have taken longer than a reasonable time (typically 30-days), then the bike may be considered a lemon.  
  • Sold With Serious Defects: Finally, a motorcycle might be considered a lemon if it was sold with serious defects.
